Timeline of the Oklahoma judicial
CRIMINAL PROCESS
A criminal prosecution is a special type of lawsuit, filed by the State, in the county which the crime allegedly occurred. There is a certain order of events, some imposed by Constitutional law. The following is an approximate timeline of the process.
Arrest
When an officer suspects a person of committing a crime, they arrest that person and bring them into custody of the State. The State then charges the person with a crime, sets a court date for the person to be "arraigned."
But first, prior to arresting the person, the officer must have either an arrest warrant or probable cause that a crime was committed in his presence. If the officer cannot satisfy these two elements, the arrest is unconstitutional and must be thrown out.
Arraignment
The sole purpose of this hearing is for the accused to hear the "information" against him (the charges filed), and to plea "guilty" or "not guilty." Upon a plea of "not guilty," the accused will be given a court date to appear at the next stage of the process.
Preliminary Conference or Disposition
This is a meeting between the defense attorney and the prosecutor, whereby both parties engage in negotiation over the charge. This opportunity is afforded only to attorneys and unrepresented persons will not be permitted to negotiate with the prosecution.
Preliminary Hearing
Prior to trial, the accused has the right (in Oklahoma) to hear the evidence against him. At a preliminary hearing, the State will present the evidence it has to charge the defendant with the crime. If the State has enough evidence to meet the standard of probable cause, then the State may proceed to trial. This is called a "bind-over" order, whereas teh defendant is bound over to stand trial.
If the State does not have sufficient evidence, or if its evidence was seized illegally, then the Court must either dismiss the charge, or suppress the evidence, or both.
Pretrial Conference
A meeting between all parties and the Judge to discuss any procedural issues prior to trial.
Trial by Jury
You have the right to trial by jury, protected by both the U.S. and Oklahoma Constitutions. The State must prove every element, of every count, beyond a reasonable doubt. You are innocent until proven guilty.
